Overtime work on a business trip: grounds for payment

According to the employer, he has the right to ask the employee to work overtime, regardless of whether the employee is on a service trip or not.

Therefore, the Ministry of Labor and Social Protection offers to rely on general recommendations for compensation of overtime work – Art. 152, 153, 154 of the Labor Code of the Russian Federation).

How is overtime work on a business trip paid?

The overtime payment on a business trip takes place in the same way as at the main workplace. The first two hours are paid for at least a and a half of the salary, the next hours – in double size.

  • If the employee was sent on a trip on the weekend, then after returning he is given an additional day of rest or monetary compensation;
  • Work on a weekend or non -working holiday is paid at least in double size;
  • The time spent on the road and the weekend that the employee spent in another city, as overtime cannot be considered – unless otherwise reflected in the labor or collective agreement;
  • The employer is not obliged to pay overtime if the employee himself decided to use his non -working time for work;
  • Overlook should not exceed four hours a day more than two working days in a row.

In addition, the company has the right to establish its own procedure, taking into account the general requirements of labor legislation. For example,

  • compensation for a rest employee;
  • increasing payment for additional hours spent on the performance of the service assignment;
  • provision of equivalent rest time (paid or unpaid – at the discretion of the parties to the employment contract);
  • payment of allowances for overtime on a business trip;
  • joining the main vacation of an additional day (days) of rest.

How to arrange overtime work if an employee is on a business trip?

Before attracting an employee to overtime on a business trip, the manager needs to contact the company’s official note. It must substantiate the need for overtime.

After the consent of the general director, the commodity employee under the sign is notified that he was offered overtime work on a business trip. There is no unified form of notification of involvement in overtime work on a business trip, so the document can be drawn up in any form.

If the employee is already in another city, then the employer can notify him by e -mail. In response, the employee will need to send a signed scan of consent.

With the consent of the employee to overtime work, the employer draws up an order to attract the employee to overtime work. It can also be compiled in any form.
